Recently, the National Council of the Public Prosecutor’s Office (CNMP) granted a <a target="_blank" rel="noopener noreferrer" href="https://painel-website.ldr.com.br/uploads/Liminar_US_0fd9ee4bd0.pdf">Preliminary Injunction</a> to suspend the effects of four Recommendations issued by the Federal Public Prosecutor’s Office (MPF), through the Federal Prosecutor’s Office in Rio Grande do Sul, regarding the environmental licensing of the so-called “Nature Project,” a large-scale development planned for the state of Rio Grande do Sul. The controversy involves, among other issues, the conduct of Free, Prior, and Informed Consultation (FPIC), as provided for in ILO Convention No. 169, with indigenous communities potentially affected by the project, rejecting interpretations that attribute binding effect or veto power to it.<h2>Key points of the CNMP’s decision</h2>In a preliminary analysis, the CNMP identified indications that the limits of the advisory instrument had been exceeded, particularly due to provisions that:<span style="-webkit-text-stroke-width:0px;display:inline !important;float:none;font-style:normal;font-variant-caps:normal;font-variant-ligatures:normal;font-weight:400;letter-spacing:normal;orphans:2;text-align:start;text-decoration-color:initial;text-decoration-style:initial;text-decoration-thickness:initial;text-indent:0px;text-transform:none;white-space:normal;widows:2;word-spacing:0px;">➜ attributed a binding nature to prior consultation; <span style="-webkit-text-stroke-width:0px;display:inline !important;float:none;font-style:normal;font-variant-caps:normal;font-variant-ligatures:normal;font-weight:400;letter-spacing:normal;orphans:2;text-align:start;text-decoration-color:initial;text-decoration-style:initial;text-decoration-thickness:initial;text-indent:0px;text-transform:none;white-space:normal;widows:2;word-spacing:0px;">➜ imposed obligations without clear legal basis; and <span style="-webkit-text-stroke-width:0px;display:inline !important;float:none;font-style:normal;font-variant-caps:normal;font-variant-ligatures:normal;font-weight:400;letter-spacing:normal;orphans:2;text-align:start;text-decoration-color:initial;text-decoration-style:initial;text-decoration-thickness:initial;text-indent:0px;text-transform:none;white-space:normal;widows:2;word-spacing:0px;">➜ directly interfered with the conduct of the environmental licensing process and with powers typically held by the Public Administration.In this context, the decision also stated that CPLI, under the terms of ILO Convention No. 169, constitutes a procedural duty of dialogue and participation, aimed at “seeking consensus,” and should not be confused with an automatic veto mechanism on the part of the consulted communities.Limits on the Public Prosecutor’s Office’s Actions The CNMP also pointed out possible inconsistencies related to the disregard of the presumption of constitutionality of legal norms and the overstepping of the constitutional and legal limits of the advisory instrument. On this point, it referred to its own precedent to the effect that the autonomy or functional independence of the Public Prosecutor’s Office is not absolute and cannot exceed legal limits, under penalty of constituting an abuse of power.<h2>Relationship with the General Environmental Licensing Law</h2>The decision gains relevance in the context of Law No. 15,190/2025 (General Environmental Licensing Law), whose constitutionality is still under debate, insofar as any recommendations by the Public Prosecutor’s Office that, in practice, preclude the application of current law—without prior judicial ruling—may, in theory, violate fundamental principles such as legality, the separation of powers, and legal certainty.<h2>Effects of the decision and significance of the precedent</h2>In recognizing the presence of the requirements for granting emergency relief, the Council also considered the risk of significant impacts on the project’s viability, highlighting its potential to generate investment and jobs. It is, therefore, a precedent with the potential to encourage more balanced and institutionally stable approaches in the conduct of large-scale projects.

Recentemente, o Conselho Nacional do Ministério Público (CNMP) concedeu&nbsp;<a target="_blank" rel="noopener noreferrer" href="https://painel-website.ldr.com.br/uploads/Liminar_2832d0892f.pdf">medida liminar</a> para suspender os efeitos de quatro Recomendações expedidas pelo Ministério Público Federal (MPF), por meio da Procuradoria da República no Rio Grande do Sul, no âmbito do licenciamento ambiental do chamado “Projeto Natureza”, empreendimento de grande porte previsto para o Estado do Rio Grande do Sul. A controvérsia envolve, entre outros pontos, a realização da Consulta Prévia, Livre e Informada (CPLI), prevista na Convenção nº 169 da OIT, a comunidades indígenas potencialmente afetadas pelo projeto, afastando interpretações que lhe atribuam efeito vinculante ou poder de veto.<h2>Principais pontos da decisão do CNMP</h2>Em análise preliminar, o CNMP identificou indícios de extrapolação dos limites do instrumento recomendatório, especialmente em razão de comandos que:➜ atribuíram caráter vinculante à consulta prévia;➜ impuseram obrigações sem respaldo normativo claro; e➜ interferiram diretamente na condução do processo de licenciamento ambiental e em competências típicas da Administração Pública.Nesse contexto, a decisão também consignou que a CPLI, nos termos da Convenção nº 169 da OIT, constitui um dever procedimental de diálogo e participação, voltado à busca de consenso e não se confunde com mecanismo de veto automático por parte das comunidades consultadas.<h2>Limites à atuação do Ministério Público</h2>O CNMP também apontou possíveis inconsistências relacionadas à desconsideração da presunção de constitucionalidade das normas legais e à extrapolação dos limites constitucionais e legais do instrumento recomendatório. Nesse ponto, fez referência a precedente próprio no sentido de que a autonomia ou independência funcional do Ministério Público não é absoluta e não pode transbordar os limites legais, sob pena de configurar abuso de poder.<h2>Relação com a Lei Geral de Licenciamento Ambiental</h2>A decisão ganha relevância no contexto da&nbsp;<a target="_blank" rel="noopener noreferrer" href="https://www.planalto.gov.br/ccivil_03/_ato2023-2026/2025/lei/l15190.htm">Lei nº 15.190/2025</a> (Lei Geral de Licenciamento Ambiental), cuja constitucionalidade ainda está em discussão, na medida em que eventuais recomendações do Ministério Público que, na prática, afastem a aplicação da lei vigente — sem prévio pronunciamento judicial — podem, em tese, afrontar princípios estruturantes como a legalidade, a separação de poderes e a segurança jurídica.<h2>Efeitos da decisão e relevância do precedente</h2>Ao reconhecer a presença dos requisitos para concessão da tutela de urgência, o Conselho também considerou o risco de impactos relevantes sobre a viabilidade do empreendimento, destacando seu potencial de geração de investimentos e empregos. Embora tenha caráter liminar, a decisão sinaliza:➜ importante baliza quanto aos limites da CPLI e ao uso de instrumentos extrajudiciais pelo Ministério Público;➜ a reafirmação da consulta prévia como etapa essencial do processo;➜ o afastamento, neste momento, de interpretações que lhe atribuam efeito vinculante ou poder de veto;➜ a configuração de precedente relevante em um contexto de elevada judicialização;➜ potencial de conferir maior previsibilidade e segurança jurídica à condução de empreendimentos sujeitos à CPLI, especialmente em um cenário em que o tema, não raras vezes, tem sido utilizado como “bala de prata” para paralisação de projetos.<h2>Conclusão</h2>Sem afastar a constitucionalidade da proteção de povos indígenas e do meio ambiente, o entendimento contribui para maior previsibilidade e segurança jurídica no licenciamento ambiental, reforçando que a CPLI deve operar como mecanismo qualificado de participação e construção de soluções, e não como fator automático de inviabilização de empreendimentos. Trata-se, portanto, de um precedente com potencial de incentivar abordagens mais equilibradas e institucionalmente estáveis na condução de projetos de grande porte.&nbsp;

On November 10, 2025, the Central Bank of Brazil (“BCB”) released Resolutions BCB Nos. 519, 520, and 521, creating Brazil’s first comprehensive regulatory framework for virtual asset service providers. The new rules stem from the BCB’s ongoing dialogue with market participants following the enactment of Law No. 14,478 of December 21, 2022, which granted the BCB regulatory authority over virtual asset activities, and from the review of more than one thousand submissions received during Public Consultations Nos. 109, 110, and 111 (the “Public Consultations”). OTHER RELEVANT PROVISIONS</h2>a) Ban on Algorithmic Stablecoins:A formal prohibition applies to the offering, listing, or intermediation of fiat-referenced virtual assets whose reserve or backing mechanisms rely on algorithms.&nbsp;Institutions already offering such products may allow clients to retain existing positions, but must discontinue the related services.b) Asset Segregation and Client Protection:VASPs must maintain full segregation between proprietary and client assets.&nbsp;BRL-denominated funds must be held in individual prepaid payment accounts, legally protected from attachment or seizure in case of insolvency.Virtual asset holdings must be recorded in segregated ledgers with mechanisms ensuring traceability and individualization of client wallets. Em 10 de novembro de 2025, o Banco Central do Brasil (“BCB”) publicou as Resoluções BCB nºs 519, 520 e 521, que instituem o primeiro marco regulatório aplicável à prestação de serviços de ativos virtuais no país. A edição das normas decorre do processo de interlocução contínua do BCB com o mercado desde a promulgação da Lei nº 14.478, de 21 de dezembro de 2022, que atribuiu ao BCB a competência para regulamentar o setor, e da análise das mais de mil contribuições recebidas no âmbito das Consultas Públicas nºs 110 e 111 (“Consultas Públicas”).&nbsp; O conjunto normativo ora publicado consolida a inserção das operações com criptoativos no Sistema Financeiro Nacional, estabelecendo requisitos de autorização, regras operacionais e obrigações de compliance alinhadas àquelas impostas a instituições financeiras, de pagamento e participantes do mercado de câmbio. Dentre os principais requisitos de autorização, destacam-se: a.&nbsp;&nbsp; &nbsp;Capacidade econômico-financeira dos controladores, demonstrando a origem lícita e suficiência do capital investido; b.&nbsp;&nbsp;&nbsp;&nbsp;Compatibilidade da Estrutura de tecnologia da informação com o porte, complexidade e riscos inerentes às atividades de custódia e intermediação de ativos virtuais; c.&nbsp;&nbsp;&nbsp;&nbsp;Reputação ilibada e experiência técnica dos administradores, controladores e principais executivos; d.&nbsp;&nbsp; &nbsp;Estrutura de governança corporativa, incluindo políticas de compliance, gestão de riscos, PLD/CFT e segurança cibernética; e e.&nbsp;&nbsp;&nbsp; Endereço físico de sede exclusivo e de uso efeito, sendo vedado o uso de coworkings ou escritórios virtuais.Capital mínimo exigido: de R$ 10,8 milhões a R$ 37,2 milhões, a depender das atividades desempenhadas.&nbsp; &nbsp;PARA ENTIDADES JÁ EM ATIVIDADE:As PSAVs em atividade devem solicitar a height="1917">&nbsp;As sociedades que protocolarem o pedido dentro do prazo podem manter a prestação dos serviços de ativos virtuais até a conclusão do seu processo de autorização, mas ficará vedada a assunção de outra modalidade nesse período.Em caso de indeferimento ou arquivamento do pedido, a PSAV deverá encerrar a prestação de serviços em até 30 dias.²O prazo é de 270 dias contados a partir de 2 de fevereiro de 2026, data em que as Resoluções BCB 519 e 520 entram em vigor.&nbsp;PARA ENTIDADES ESTRANGEIRAS:As PSAVs constituídas no exterior que prestam serviços de ativos virtuais no Brasil terão prazo de 270 dias para:A) Constituírem uma entidade local, que deverá passar pelo mesmo processo de autorização; OUB) Transferirem suas operações e clientes para instituição já autorizada no país.&nbsp;PARA DEMAIS INSTITUIÇÕES AUTORIZADAS:As demais instituições já autorizadas a funcionar pelo BCB, elegíveis para prestar os serviços de intermediação e custódia de ativos virtuais, quais sejam: (I) os Bancos Múltiplos, Comerciais, de Investimento ou de Câmbio; e (II) as Sociedades Corretoras e Distribuidoras de Valores Mobiliários (CTVMs e DTVMs), poderão prestar serviços nas Stablecoins&nbsp;algorítmicas:Vedação expressa a oferta, listagem ou intermediação de ativos virtuais referenciados em moeda fiduciária cujos mecanismos de lastro ou controle de reserva sejam realizados por meio de algoritmos.&nbsp;Para aquelas instituições que já ofereciam esse produto, os clientes poderão mantê-los na carteira, porém a prestação desse serviço deverá ser cessada.b) Segregação patrimonial e proteção ao cliente:Deverá ser mantida a separação integral entre os recursos próprios das PSAVs e os recursos dos clientes.Os recursos em Reais devem ser mantidos em contas de pagamento pré-pagas individualizadas, legalmente protegidas contra constrições decorrentes de eventual liquidação da instituição.Já os recursos em ativos virtuais devem ser mantidos em registros segregados e com mecanismos que assegurem a rastreabilidade e individualização das carteiras dos clientes, não sendo permitido o uso das “contas-bolsão”.&nbsp;Na Coletiva, o BCB ressaltou que a plena The National Data Protection Authority (Autoridade Nacional de Proteção de Dados – ANPD) is now the National Data Protection Agency, linked to the Ministry of Justice, endowed with functional, technical, decision-making, administrative, and financial autonomy – the same institutional status as other established regulatory agencies, such as ANEEL, ANATEL, and ANVISA.This change results from the entry into force of Provisional Measure No. 1,317/2025, published on September 18, 2025, and forms part of a set of measures aimed at enabling the implementation of the Digital Child and Adolescent Statute (ECA Digital), established by Law No. 15,211 of September 17, 2025.<h2>Key Aspects of the Change</h2>➜&nbsp;New regulatory status: the ANPD has been renamed the National Data Protection Agency, vested with functional, technical, decision-making, administrative, and financial autonomy.
