Data Protection | Provisional Measure 959 – Postponement of the date of entry in force of the Brazilian General Data Protection Law (LGPD)
The Federal Government released yesterday, April 29th, 2020 Provisional Measure 959, which, among other measures, disposes on the postponement of the date for entry in force of the General Data Protection Law (LGPD) to May 3, 2021. LGPD was expected to come into force in August this year.
Provisional Measures are acts with the force of law issued by the President of the Republic in situations of relevance and urgency. Despite having immediate legal effects, the Provisional Measures need to be approved by the Chamber of Deputies and the Federal Senate to be definitively converted into federal law, otherwise it will lose its effects.
As it is an act published during the Covid-19 pandemic, the processing of the MP 959 will be subjected to a simplified rite as provided for in the Joint Act of the Tables of the Chamber of Deputies and the Federal Senate No. 1, 2020.
We emphasize that several bills related to LGPD are being processed in the National Congress. Among them, PL 1,179, recently approved by the Senate and under analysis by the Chamber of Deputies, which provides for the postponement of the General Data Protection Law (LGPD) to January 1st, 2021. According to the text, the fines and penalties for companies that do not comply with LGPD would come into force in August 15th, 2021.
