INPI institui fase II do Projeto Piloto PPH PROSUL

O Instituto Nacional de Propriedade Industrial (INPI) publicou hoje (4) a Resolução No. 224/2018, que institui a fase II do Projeto Piloto de Exame Compartilhado de Patentes (PPH - Patent Prosecution Highway) PROSUL, que inclui os escritórios pertinentes do Brasil, Chile, Argentina, Colômbia, Equador, Paraguai, Peru e Uruguai. Trata-se de uma das medidas adotadas pelo INPI para acelerar o exame de pedidos de patente, reduzindo o backlog. Neste modelo de acordo entre dois países ou regiões, o exame do pedido de patente em um dos países pode ser acelerado, após ter sido concedido pelo outro, mediante requisição do solicitante do pedido e se atendidas às condições para ingresso no programa, conforme publicação em Resolução. Com isto, calcula-se que o prazo do exame pode ser reduzido para, em média, nove meses - tempo até o exame, após entrada no PPH. Neste caso de PPH entre INPI e países do PROSUL, não há limitação de campo tecnológico. O pedido de patente deve pertencer a uma família cujo pedido mais antigo foi depositado em um Instituto de Patente do PROSUL ou, em caso de PCT, em um Instituto de Patente do PROSUL atuando como autoridade de busca. A participação no programa poderá ser requerida até o dia 30/06/2019, e cada depositante poderá participar com até 1 processo a cada ciclo mensal, exceto pelo último mês, quando não haverá limite. Dentre os requisitos necessários, e de forma semelhante à requerida por outros programas PPH já em vigor, o pedido de patente deve ter sido publicado e o exame, requerido. Além disso, o pedido deverá ter sido alterado para suficientemente corresponder à matéria que o Instituto de Patentes do PROSUL considerou patenteável no pedido de mesma família, respeitadas as disposições legais pertinentes. A concessão do trâmite prioritário será anulada de ofício caso haja, voluntariamente, divisão ou modificação do pedido de patente antes da publicação do primeiro parecer técnico. PROSUL includes the pertinent offices in Brazil, Chile, Argentina, Colombia, Ecuador, Paraguay, Peru and Uruguay. This is one of the measures adopted by INPI for expediting the examination of patent applications, reducing the backlog. In this model of agreement between two countries or regions, the examination of the patent application in one of the countries may be accelerated, after being granted by the other, upon request by the applicant and if the conditions for joining the program, as published in the Resolution, are met. By joining the program, it is estimated that the examination period can be reduced to about nine months - time until the examination, after entering the PPH pilot program. In this particular case of PPH between INPI and PROSUL countries, all technology fields are contemplated. The application must belong to a family whose oldest application was filed at a PROSUL Patent Office or, in case of a PCT, at a PROSUL Patent Office acting as a search authority. Participation on the program may be requested until June 06, 2019 and each applicant can participate with up to 1 process each monthly cycle, except for the last month, when there will be no limit. Among the necessary requirements, and similarly as already established by other PPH Programs in force, the patent application must have been published and the examination requested. Additionally, the application must have been amended to sufficiently correspond to the matter considered to be patentable in the application of the same family by the PROSUL Patent Office, given that the legal dispositions are complied with. It is worth pointing out that the acceptance into the program will be canceled ex officio in case of voluntary division or modification of the patent application before the publication of the first technical opinion.
